Настоящие Условия использования (далее — «Условия») регулируют отношения между Индивидуальным предпринимателем Соболевым Андреем Владимировичем (ИНН 420534014211), далее «Posta», и пользователем сервиса автоматизации публикаций в социальных сетях, доступного по адресам posta-smm.ru и posta-smm.com (далее — «Сервис»).
Регистрируясь и используя Сервис, вы подтверждаете, что прочли, поняли и согласны с настоящими Условиями. Если вы не согласны хотя бы с одним пунктом — пожалуйста, не используйте Сервис.
Posta — это онлайн-сервис, который помогает специалистам бьюти-индустрии и малому бизнесу автоматизировать создание и публикацию контента в социальных сетях (Instagram, Threads, Telegram и другие). Основные функции:
Сервис предоставляется на условиях «как есть» и может развиваться: функции могут добавляться, изменяться или удаляться.
Для использования Сервиса вы создаёте учётную запись. Вы обязуетесь:
Сервис могут использовать лица, достигшие 18 лет либо имеющие согласие законных представителей.
Сообщения Сервиса. Сервис отправляет вам два типа сообщений. Служебные — о работе вашего аккаунта: коды входа, состояние подключённых соцсетей, ошибки публикации, существенные изменения в Сервисе. Они являются частью Сервиса, и отказаться от них нельзя, пока аккаунт существует. Информационные — напоминания и подсказки по использованию Сервиса; от них можно отказаться в любой момент в один клик, на работу аккаунта это не влияет.
Для работы Сервис требует подключения ваших аккаунтов в социальных сетях через официальные API (Instagram Graph API, Threads API, Telegram Bot API). Подключая аккаунты, вы подтверждаете:
Posta не несёт ответственности за блокировку, ограничение или иные действия со стороны социальных сетей в отношении ваших аккаунтов.
При использовании Сервиса запрещено:
Posta вправе ограничить или прекратить ваш доступ к Сервису в случае нарушения настоящих условий, без возврата уплаченных средств.
Сервис использует языковые модели и модели генерации изображений для создания контента по вашему запросу. Вы понимаете и соглашаетесь, что:
Сервис позволяет пользователю включить публичную страницу записи и принимать через неё записи своих клиентов.
Включая эту страницу, пользователь поручает Posta обработку персональных данных своих клиентов (имя, телефон, комментарий, услуга, дата и время визита) в объёме и с целями, описанными в Политике конфиденциальности. Оператором этих данных является сам пользователь; Posta действует как обработчик по его поручению и не использует эти данные в собственных целях.
Пользователь обязуется: размещать ссылку на страницу записи только от своего имени; поддерживать в актуальном состоянии услуги и расписание; отвечать на обращения своих клиентов по поводу их персональных данных; не использовать форму записи для сбора данных, не нужных для приёма клиента.
Сервис не является стороной отношений между пользователем и его клиентом. Posta не принимает оплату за услуги пользователя, не выступает посредником в расчётах, не гарантирует явку клиента и не отвечает за качество оказанных пользователем услуг, перенос или отмену визита.
Мы вправе временно отключить страницу записи конкретного пользователя, если она используется для рассылки спама, обмана или сбора данных не для записи на приём.
Сервис может предоставляться на платной основе по модели подписки. Условия тарифов, способы оплаты и порядок возврата указаны в разделе «Тарифы» или в личном кабинете. Подписка автоматически продлевается до её отмены пользователем.
В период beta-доступа отдельные функции Сервиса могут предоставляться бесплатно или с ограничениями.
Все права на Сервис, его дизайн, программный код, торговые знаки и иные результаты интеллектуальной деятельности принадлежат Posta. Использование Сервиса не предоставляет вам прав на эти объекты, кроме права использовать Сервис согласно настоящим Условиям.
Контент, созданный вами (включая тексты ваших промптов и медиафайлы, которые вы загружаете), остаётся вашей собственностью. Вы предоставляете Posta ограниченную лицензию на использование этого контента исключительно для предоставления функций Сервиса.
Сервис предоставляется «как есть», без каких-либо явных или подразумеваемых гарантий. В максимальной степени, разрешённой применимым правом, Posta не несёт ответственности за:
Вы можете прекратить использование Сервиса в любой момент, удалив свою учётную запись в настройках. О процедуре удаления данных см. страницу «Удаление данных».
Posta вправе приостановить или прекратить ваш доступ к Сервису в случае нарушения настоящих Условий, законодательства или при иных существенных обстоятельствах.
К настоящим Условиям применяется законодательство Российской Федерации. Все споры, возникающие из настоящих Условий, подлежат разрешению в судах по месту нахождения Оператора, если иное не предусмотрено законом.
Posta вправе вносить изменения в настоящие Условия. Актуальная версия всегда доступна по адресам posta-smm.ru/terms и posta-smm.com/terms. О существенных изменениях мы уведомим вас по email или внутри Сервиса. Продолжая использовать Сервис после уведомления, вы подтверждаете согласие с обновлёнными Условиями.

By registering for and using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree with even a single provision, please do not use the Service.
Posta is an online service that helps beauty-industry professionals and small businesses automate the creation and publication of content on social media (Instagram, Threads, Telegram, and others). Core features:
The Service is provided on an “as is” basis and may evolve: features may be added, changed, or removed.
To use the Service, you create an account. You undertake to:
The Service may be used by persons who have reached 18 years of age or who have the consent of their legal representatives.
Messages from the Service. The Service sends you two kinds of messages. Service messages concern your account: login codes, the state of connected social networks, publishing errors, material changes to the Service. They are part of the Service and cannot be opted out of while the account exists. Informational messages are reminders and tips on using the Service; you may opt out of them at any time in one click, and this does not affect how your account works.
To operate, the Service requires connecting your social media accounts via official APIs (Instagram Graph API, Threads API, Telegram Bot API). By connecting accounts, you confirm that:
Posta is not responsible for blocking, restriction, or other actions taken by social networks with respect to your accounts.
When using the Service, it is prohibited to:
Posta is entitled to restrict or terminate your access to the Service in the event of a violation of these terms, without refunding any amounts paid.
The Service uses language models and image-generation models to create content at your request. You understand and agree that:
The Service allows a user to enable a public booking page and accept bookings from their own clients through it.
By enabling this page the user instructs Posta to process the personal data of their clients (name, phone number, comment, service, date and time of the visit) within the scope and for the purposes described in the Privacy Policy. The user is the data controller for this data; Posta acts as a processor on their instructions and does not use this data for its own purposes.
The user undertakes to: publish the booking link only on their own behalf; keep services and schedule up to date; respond to their clients’ requests regarding personal data; and not use the booking form to collect data that is not needed to receive the client.
The Service is not a party to the relationship between the user and their client. Posta does not take payment for the user’s services, does not act as an intermediary in settlements, does not guarantee that a client will show up and is not responsible for the quality of services provided, or for rescheduling or cancellation of a visit.
We may temporarily disable a particular user’s booking page if it is used for spam, deception or for collecting data unrelated to accepting bookings.
The Service may be provided on a paid basis under a subscription model. The terms of the plans, payment methods, and refund procedures are specified in the “Pricing” section or in your personal account. The subscription renews automatically until cancelled by the user.
During the beta-access period, certain features of the Service may be provided free of charge or with limitations.
All rights to the Service, its design, software code, trademarks, and other results of intellectual activity belong to Posta. Use of the Service does not grant you any rights to these objects, except for the right to use the Service in accordance with these Terms.
Content created by you (including the texts of your prompts and the media files you upload) remains your property. You grant Posta a limited license to use this content solely for the purpose of providing the features of the Service.
The Service is provided “as is”, without any express or implied warranties. To the maximum extent permitted by applicable law, Posta is not liable for:
You may stop using the Service at any time by deleting your account in the settings. For the data-deletion procedure, see the “Data Deletion” page.
Posta is entitled to suspend or terminate your access to the Service in the event of a violation of these Terms, of the law, or under other material circumstances.
These Terms are governed by the laws of the Russian Federation. All disputes arising out of these Terms shall be resolved in the courts at the location of the Operator, unless otherwise provided by law.
Posta is entitled to make changes to these Terms. The current version is always available at posta-smm.ru/terms and posta-smm.com/terms. We will notify you of material changes by email or within the Service. By continuing to use the Service after such notification, you confirm your agreement with the updated Terms.
